The Mesothelioma Bill, which was passed by Parliament to provide compensation to sufferers of mesothelioma who could not trace the relevant employers’ liability insurer, is now open to applications and payments will come into operation in July 2014.
The Governments new Diffuse Mesothelioma Payment Scheme means that sufferers who cannot trace a relevant Employers’ Liability Insurer are able to claim 100% of the average compensation which would have been secured in a ‘normal’ civil claim through the courts.
HASAG welcome the implementation of the scheme. Their panel of solicitors are submitting applications so that mesothelioma sufferers who are eligible, are able to receive the compensation they are entitled to as soon as possible.
The Scheme is open to people diagnosed with mesothelioma, after 25th July 2012, who cannot trace the relevant Employers’ Liability Insurer.
The scheme is not perfect. It only benefits those diagnosed after 25th July 2012. It is, however, much better than before when those that fit the criteria would have received nothing at all.
Unfortunately, the scheme does not benefit those with other asbestos related diseases such as lung cancer who are in a similar position.
Mesothelioma sufferers have faced many legal challenges in recent years and we will continue to fight for their rights because what they really deserve is full and fair financial security for their families.
